AI Services and Third-Party Providers

Third-Party AI Models

Our services utilize AI models from third-party providers including, but not limited to: - OpenAI (GPT models) - Anthropic (Claude models) - Google (Gemini models) - xAI (Grok models) - Moonshot AI (Kimi models) - DeepSeek - Other providers as indicated

Your use of our services is subject to the terms and acceptable use policies of these underlying AI providers. By using AYETO.ai, you agree to comply with all applicable provider policies.

International Data Processing

Your data may be processed by AI providers located in various jurisdictions, including but not limited to the United States, European Union, and other countries. By using our services, you consent to such international data transfers. For users in the EEA, we implement appropriate safeguards including Standard Contractual Clauses where applicable.

Transfers to Third Countries Without Adequacy Decisions

Some of our AI providers are located in countries that have not received an adequacy decision from the European Commission, including: - China: DeepSeek, Moonshot AI - Singapore: Moonshot AI (partial operations)

For transfers to these countries, we rely on: - Standard Contractual Clauses (SCCs) approved by the European Commission - Your explicit consent obtained through acceptance of these Terms - Contractual necessity for the performance of services you requested

Important Notice: Data transferred to countries without adequacy decisions may be subject to different legal frameworks that may not provide the same level of data protection as EU law. By using AI services powered by providers in these jurisdictions, you acknowledge and accept this risk.

Your Rights Regarding International Transfers

You have the right to: - Request information about the specific safeguards in place for international transfers - Obtain a copy of the Standard Contractual Clauses upon request - Choose not to use specific AI models that process data in jurisdictions you are not comfortable with (where alternative models are available)

AI Output Disclaimer

No Guarantee of Accuracy

Our AI-powered services use experimental technology. Due to the uncertainty and probabilistic nature of machine learning, we cannot guarantee the accuracy, completeness, or reliability of AI-generated content ("Output").

Critical Limitations

When using our services, you acknowledge and agree that:

  1. Not a Sole Source of Facts: AI Output should not be regarded as the sole source of factual information. You must independently assess and verify the accuracy of all Output.

  2. Not Professional Advice: AI Output is NOT a substitute for professional advice. You must NOT rely on Output for: - Medical diagnosis, treatment, or healthcare decisions - Legal advice or legal document preparation - Financial, investment, or trading decisions - Tax or accounting advice - Educational assessments or academic decisions

  3. No Decisions About People: You must NOT use AI Output for purposes that could have a legal or material impact on any person, including but not limited to: - Credit and lending decisions - Employment and hiring decisions - Housing and rental decisions - Insurance underwriting - Educational admissions - Criminal risk assessment - Any automated decision-making with legal effects

  4. Similar Outputs: Due to technical limitations, similar or identical Output may be generated for different users. We do not guarantee uniqueness of any Output.

  5. Not Our Views: AI Output does not represent the views, opinions, or endorsements of AYETO.ai.

Acceptable Use Policy

Prohibited Content and Activities

You must NOT use AYETO.ai to generate, process, or distribute:

Harmful Content: - Content promoting violence, terrorism, or illegal activities - Child sexual abuse material (CSAM) or content sexualizing minors - Malware, viruses, or tools for cyberattacks - Content for harassment, bullying, stalking, or defamation - Content promoting self-harm or suicide - Non-consensual intimate imagery

Deceptive Practices: - Deepfakes or misleading content intended to deceive - Spam, phishing, or fraudulent communications - Impersonation of individuals or organizations without authorization - Disinformation or manipulation of public opinion - Academic dishonesty or plagiarism

Discrimination and Profiling: - Social scoring or evaluation of individuals based on social behavior - Criminal risk prediction based solely on personal traits - Exploitation of vulnerabilities related to age, disability, or socio-economic status - Content promoting hatred or discrimination based on protected characteristics

Biometric and Surveillance: - Real-time remote biometric identification in public spaces - Creation or expansion of facial recognition databases without consent - Unauthorized surveillance or monitoring of individuals - Emotion inference in workplace or educational settings (except for medical/safety purposes)

Sensitive Data Processing: - Processing personal data of children under 14 years (or applicable age of digital consent) - Processing Protected Health Information (PHI) as defined by HIPAA or equivalent regulations - Processing of special category data without proper legal basis

Technical Misuse: - Reverse engineering, decompiling, or disassembling our services or AI models - Attempting to extract model weights, algorithms, or source code - Bypassing, disabling, or circumventing safety filters or security measures - Using variants, random characters, or techniques to evade content detection - Developing AI systems competitive with our services or our providers' services - Automated scraping, harvesting, or extraction of data from our services - Reselling, sublicensing, or redistributing our services without authorization

Consequences of Violation

Violation of this Acceptable Use Policy may result in: - Immediate account suspension or termination without prior notice - Forfeiture of any prepaid credits without refund - Permanent ban from our services - Reporting to relevant law enforcement authorities - Legal action to recover damages

User-Generated Content

Users may submit text, images, or other content ("User Content" or "Input"). By doing so, you represent that you own or have necessary rights to the content. While you retain ownership, you grant AYETO.ai a worldwide, non-exclusive, royalty-free license to use, process, and store your content solely for the purpose of providing the services.

You are solely responsible for all Input you submit and must ensure it complies with these Terms, our Acceptable Use Policy, and all applicable laws.

Intellectual Property

Our Services

All content, features, and functionality of AYETO.ai (including text, software, images, trademarks, and logos) are owned by AYETO.ai, its licensors, or providers, and are protected by EU and international intellectual property laws. Unauthorized reproduction, distribution, or use is strictly prohibited.

AI-Generated Content

Subject to your compliance with these Terms: - You may use AI-generated Output for lawful purposes - We do not claim ownership of Output generated specifically for you - You acknowledge that similar Output may be generated for other users - Output may incorporate or be influenced by third-party content - You are responsible for ensuring your use of Output does not infringe third-party rights

E-Commerce and Purchase Plans

AYETO.ai allows users to purchase credits via our platform. By completing a purchase, you agree to our sales terms, including pricing and payment policies. We offer credit-based plans with various features. By purchasing, you agree to the specific billing terms outlined for your plan.

Refund Policy

New customers may request a full refund within 14 days of their first purchase if unsatisfied, in accordance with EU consumer protection laws. Refunds are not available after this period or if services have been substantially used. Refunds are not available for violations of these Terms or our Acceptable Use Policy.

Warranties and Disclaimer

As-Is Service

The Services and all AI-generated Output are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to: - Warranties of merchantability - Fitness for a particular purpose - Accuracy, reliability, or completeness of Output - Uninterrupted, error-free, or secure operation - Correction of defects - Non-infringement

AI-Specific Disclaimer

We provide no warranty that AI-generated content will be: - Accurate, complete, current, or factually correct - Free from bias, errors, or offensive content - Suitable for any particular purpose - Consistent across multiple requests - Compliant with any specific professional standards

Limitation of Liability

Exclusions

To the maximum extent permitted by law, AYETO.ai and its affiliates, licensors, and service providers shall not be liable for: - Any indirect, incidental, special, consequential, or punitive damages - Loss of profits, revenue, data, or business opportunities - Damages arising from reliance on AI-generated Output - Decisions made based on AI Output - Errors, omissions, or inaccuracies in AI responses - Any use of Output for prohibited purposes - Unavailability or changes in AI model capabilities

Maximum Liability

Our total aggregate liability arising out of or in connection with these Terms shall not exceed the greater of: (a) the amount you paid to us in the six months preceding the event giving rise to the liability, or (b) €100.

Preserved Rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Your statutory rights as a consumer are not affected.

Feedback and Suggestions

We welcome user feedback to improve our services. By submitting suggestions, you agree that AYETO.ai may freely use, modify, or implement your ideas without compensation or notice.

Changes to Terms

AYETO.ai reserves the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice before taking effect. Continued use after changes constitutes acceptance. If you do not agree with changes, you must stop using the services before they take effect.

Governing Law

These Terms and your use of AYETO.ai are governed by the laws of the Czech Republic, excluding conflict of law principles. Disputes will be resolved in courts located in Prague. For consumers within the EEA, you may also bring proceedings in your country of residence.
